Police will not take a report due to the civil nature of the case. Follow up with the court, as this does not rise to the level of a criminal act.
Only the Nevada Attorney General’s Office (opens in a new tab) can enforce violations of NRS 200.359 (opens in a new tab), which applies to situations where a parent attempts to hide or detain a child from another guardian, as well as Pick-Up Orders. A child custody violation is not classified as kidnapping.
The Nevada Attorney General’s Office is responsible for prosecuting all Hide and Detain cases in the State of Nevada.
The LVMPD Missing Persons Section assists the Attorney General’s Office by contacting parents, gathering information, and confirming whether a family court custodial violation has occurred.
These cases are civil in nature, meaning LVMPD cannot criminalize them or forcibly remove a child from a custodial parent in connection with a civil custodial violation.
Once a custodial violation is confirmed, the case is forwarded to the Nevada Attorney General’s Office for further investigation and prosecution.

Police will get involved if the child is in immediate danger or if there are allegations of abuse or neglect.
