Child Custody
If there is no family court order in place in Clark County, then contact Clark County Family Court or call (702) 455-2385.
Police will not take a report due to the civil nature of the case. Please follow up with the court because this does not rise to the level of a criminal act.
Only the Attorney General’s Office can enforce violations of NRS 200.359 (parents who attempt to hide or detain a child from another guardian) and Pick Up Orders. A child custody violation case is not classified as kidnapping.
The Nevada Attorney General’s Office is responsible for prosecuting all Hide and Detain cases in the State of Nevada.
The LVMPD Missing Persons Section assists the Attorney General’s Office by contacting parents, gathering information, and confirming whether a family court custodial violation has occurred.
These cases are civil in nature, meaning the LVMPD cannot criminalize them or forcibly remove a child from a custodial parent in connection with a civil custodial violation.
Once a custodial violation is confirmed, the case is forwarded to the Nevada Attorney General’s Office for further investigation and prosecution.
Nevada Attorney General's Office can be contacted at 775-684-1100 or by email AGinfo@ag.nv.gov
Police will get involved if the child is in immediate danger or if there are allegations of abuse and or neglect.
